These Terms
and conditions comprise a binding contract
between you as an authorised user of the PIC
online print
service and PIC for the purchase of photographic
prints uploaded via the Internet or sent
to us on a CD. By submitting an order, you
agree to
be bound by these Terms and Conditions.
PIC will not be responsible for any loss or damage
howsoever arising as a result of a failure on the
part of PIC to fulfil an order. The offer and description
of this service by PIC does not in itself represent
an agreement to accept an order or supply prints
in accordance with these Terms and Conditions.

Delivery of prints.
All prints will be delivered to the address
supplied by you on the details section
of order process. Your order will be accepted
upon submission by you for an offer to
buy prints using the appropriate order
facility and upon PIC notifying you by
e-mail that your order has been accepted
and has agreed to supply the prints to
you.

Time for delivery is a best
estimate and PIC shall not be liable for any
loss
or damage arising as a result of late
delivery of the prints.

Orders may be refused without
explanation and entirely at the discretion
of PIC.

Price/Specification
All orders to be shipped within the European
Union include UK Value Added Tax at the
appropriate rate (currently 17.5%). Postage
and packaging where appropriate will be
listed separately. PIC shall not be liable
for any other taxes or duties that may
be imposed upon you and for which will
remain fully responsible.
Prices and specifications are subject to
change without notice in any circumstances
other than where an order has been accepted
by PIC.
The purchase price is payable in advance
by credit card. We reserve the right to refer
to your credit card provider and any other
credit reference agency or bank.

Returns
In the event you are unhappy with any aspect
of our service, you will be entitled to
send the prints back to PIC within 28 days
of receipt whereupon PIC will provide a
full refund of purchase price.

PIC will use all reasonable
endeavours to prevent any breaches of security
including
credit card details provided
by you and further to use all reasonable endeavours
to ensure
that any PIC supplier/sub-contractor
or agent exercises the same standard of care
similarly
to prevent breaches of confidence.

PIC reserves the right without
notice to suspend or alter the operation of
its
services at its sole discretion
and without reason. In such circumstances notice
will
be provided wherever possible.

It is understood that you
are solely responsible for the security and
use of any
user names and passwords
needed to access the service or any part of
it.

You warrant and undertake
that you are of least 18 years of age and the
authorised
owner of the credit card
details which you supply to PIC.

You warrant that you will
not use the service for any fraudulent or illegal
purpose,
for the transmission
or posting of computer viruses or any material
which is defamatory,
offensive or obscene,
and you accept and undertake that you will
be liable for any
action taken against
PIC in relation to such use and will fully
indemnify PIC against
all actions, claims,
demands or costs which may arise as a result.

You agree and undertake
with PIC that you are the owner of the copyright
in any
material that you send us for reproduction.

PIC's liability to you
shall be limited to the sum of £50 for any one incident
or series of related incidents and up to
a total of £100
for all incidents
in any period of
twelve months.

PIC shall not be liable
for any economic loss, profits or anticipated
savings, any
loss of goodwill
and reputation or any loss of data or any consequential
loss as a result
of breach of contract and/or negligence.

Nothing in these Terms
and Conditions shall confer on any third party
any benefit
or right to
enforce any term of this Agreement. The Contracts
(Rights of Third Parties) Act
1999 shall
not apply to these purchase terms.

These Terms and conditions
form the entire agreement between you and PIC
and supersede any oral or written communication
agreements or other representations. PIC reserves
the right to add or change these Terms and
Conditions at its sole discretion at any time
without prior notice.

These Terms and Conditions
are governed by the laws of England and are
subject to
the exclusive jurisdiction of the English
courts.
